1. INTRODUCTION
FOU Fuera de LO COmún, in its capacity as the party responsible for data processing, presents this document to comply with current regulations and define the framework for handling requests and claims regarding the processing of personal data collected and managed in accordance with Statutory Law 1581 of 2012, Regulatory Decree 1377 of 2013, and other complementary regulations.
The right to Habeas Data, according to the law, is the right every person has to know, update, and rectify the information collected about them in public or private databases and archives. This guarantees all citizens the power to decide and control their personal information. In this regard, FOU Fuera de LO COmún defines these policies in this document, considering that, in the development of its corporate purpose, it continuously collects and processes personal data.
2. DEFINITIONS
a) Authorization: Prior, express, and informed consent from the Data Subject to carry out the Processing of personal data.
b) Database: An organized set of personal data that is subject to Processing.
c) Personal Data: Any information linked or that can be associated with one or several determined or determinable natural persons.
d) Data Processor: A natural or legal person, public or private, who, alone or in association with others, performs the Processing of personal data on behalf of the Data Controller.
e) Data Controller: A natural or legal person, public or private, who, alone or in association with others, decides on the database and/or the Processing of the data.
f) Data Subject: The natural person whose personal data is subject to Processing.
g) Processing: Any operation or set of operations on personal data, such as collection, storage, use, circulation, or deletion.
3. PURPOSE
In this policy, FOU Fuera de LO COmún establishes the necessary guidelines to protect the Personal Data of the Data Subjects, as well as the purpose of collecting the information, the rights of the Data Subjects, the department responsible for handling complaints and claims, and the procedures to be followed by the Data Subjects to know, update, rectify, and/or delete their information.
4. SCOPE OF APPLICATION
This Manual applies to all personal databases in the possession of FOU Fuera de LO COmún, including databases of employees and suppliers, and those managed by Data Processors acting on behalf of FOU Fuera de LO COmún. These policies apply to personal data registered in any database that is subject to Processing by FOU Fuera de LO COmún, as well as by Data Processors acting on its behalf, with the limitations and restrictions established by law, provided that the information is not public.
